Contest Rules
Wine Story Contest
Open only to legal residents of Canada and live in Ontario and are at least 19 years of age at the date of entry.
By entering this Contest, entrants agree to be bound by these Official Rules. Any violation of these rules may, at Sponsor's discretion, result in disqualification. All decisions of the judges regarding this Contest are final and binding in all respects.
1. CONTEST PERIOD, which begins on December 1st, 2011 and ends February 29th, 2012 at 11:59 PM EDT, when all entries must be, received.
2. ELIGIBILITY. This contest is only open to legal residents of Canada and living in the Province of Ontario and who are at least 19 years old as of the date of entry. This Contest is not open to directors, officers, or employees of Vin Bon or its affiliates, subsidiaries, related companies, advertising and promotional agencies, representatives or agents (collectively the "Group) or the member of, or a person living in the same household as anyone belonging to the Group. For the purpose of this Contest, "immediate family" means spouse, mother, father, brother, sister, son and daughter, whether or not they reside in the same household.
3. A total of one (1) winner will be selected and will be drawn at random from all eligible entries collected. One (1) entry per person. Multiple entries will be disqualified.
4. The email address and birth date listed on the entry are considered to be the participant number for this sweepstakes. The selected winner will be notified by email on March 5th, 2012.
5. No purchase or payment is necessary in order to participate in the Contest. A purchase will not improve chances of winning.
6. HOW TO ENTER. Visit www.vinbon.ca (the "Online Contest Entry Form") during the Contest Period by clicking Like on the Page and following the instructions to complete the entry form and pressing submit by no later than the Contest Closing Date. Only online entries will be accepted.
7. There is one (1) prize available to be won, namely a Wine Story for 20 Guests presented by Vin Bon this includes Hors d'Oeuvres, cheese, wine, servers and a Vin Bon representative, enough for 20 guests.
8. The Prize is not transferable. No cash value.
9. VinBon.ca reserves the right to disqualify any person tampering with the entry process.
10. By entering the Contest, you consent to Vin Bon's collection, use and disclosure of the personal information provided in the Contest Entry Form for the administration of the Contest and in aggregated form in order to create reports regarding Contest entrant demographics, which Vin Bon will not release or sell to any third party it is for the sole use of Vin Bon's Contest.
11. If you indicate on your Contest Entry Form that you wish to receive information on upcoming specials and promotions from Vin Bon, you consent to their use of your personal information (including e-mail address) for that purpose.
12. Vin Bon reserves the right to withdraw, cancel, terminate, modify or suspend all or any part of the Contest by publishing a notice on Vin Bon's website at [www.vinbon.ca] if Vin Bon in its discretion determines that for any reason the Contest is not capable of being conducted as planned, including due to computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts or interferes with the administration, security, fairness, integrity or proper conduct of the Contest.
13. WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE VIN BON'S WEBSITE OR INTERFERE WITH THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND VIN BON RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER RELIEF FROM ALL RESPONSIBLE PERSONS TO THE FULLEST EXTENT PERMITTED BY LAW.
14. To the extent permitted by law, Vin Bon is not responsible or liable, jointly or severally, for any of the following:
a. erroneous, damaged, destroyed, lost, late, incomplete, illegible, incorrectly addressed or misdirected Contest Entry Forms, regardless of the cause;
b. failure for any reason whatsoever of a selected entrant to receive a prize notification email;
c. changes in entrants' email address after the Contest Entry Forms are submitted;
d. computer, online, telephone, communication, or technical malfunctions or errors that may occur, regardless of the cause; or
e. damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the Contest, or the submission of Contest Entry Forms to the Contest, or participation in the Contest, or the Prize, or the use of Vin Bon's website, or the use or misuse of entrants' personal information, and regardless of the cause or any negligence by Vin Bon or any person or entity for whom it is responsible, and notwithstanding that any of those entities or persons may have been advised of the possibility of such loss or damage being incurred.
15. Decisions of Vin Bon regarding any and all aspects of the Contest are final and binding on all entrants.
16. Vin Bon is not required to engage in correspondence regarding the Contest with any person at any time other than the selected entrant.
17. The Contest is subject to all applicable laws and regulations, and is void where prohibited by law. If any provision of these rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.
18. THE CONTEST AND ALL RELATED MATTERS ARE GOVERNED SOLELY BY THE LAWS OF ONTARIO, CANADA AND APPLICABLE FEDERAL LAWS OF CANADA, EXCLUDING ANY RULES OF PRIVATE INTERNATIONAL LAW OR THE CONFLICT OF LAWS WHICH WOULD LEAD TO THE APPLICATION OF ANY OTHER LAWS. ANY DISPUTE BETWEEN VIN BON AND YOU OR ANY OTHER PERSON ARISING FROM, CONNECTED WITH OR RELATING TO THE CONTEST, ENTRIES TO THE CONTEST, PARTICIPATION IN THE CONTEST, THE PRIZE, THE USE OF VIN BON'S' WEBSITE, THE USE OR MISUSE OF ENTRANTS' PERSONAL INFORMATION, OR ANY RELATED MATTERS (COLLECTIVELY, "DISPUTES") MUST BE RESOLVED BEFORE THE COURTS OF ONTARIO SITTING IN THE CITY OF TORONTO, ONTARIO, CANADA, AND YOU HEREBY IRREVOCABLY SUBMIT AND ATTORN TO THE ORIGINAL AND EXCLUSIVE JURISDICTION OF THOSE COURTS IN RESPECT OF ALL DISPUTES. PROCEEDINGS REGARDING DISPUTES MUST BE COMMENCED IN A COURT OF COMPETENT JURISDICTION IN THE CITY OF TORONTO, ONTARIO, CANADA WITHIN ONE (1) YEAR AFTER THE DISPUTE AROSE, AFTER WHICH TIME ANY AND ALL PROCEEDINGS REGARDING THE DISPUTE ARE BARRED.
19. Participation in the Contest constitutes irrevocable acceptance of and agreement to all of these.
